Terms of Service

Welcome to StartBNE. These Terms of Service (Terms) govern your access to and use of our website, events, communities, content, and related services (collectively, Services). By accessing or using the Services, registering for an account, joining a group, or purchasing a ticket, you agree to these Terms. If you do not agree, please do not use the Services.

1) Who we are

StartBNE is a Brisbane-based community for people who want to start and build projects, businesses, and goals. We provide networking events, Communities of Support, accountability sessions, and related resources designed to create clarity, momentum, and connection.

2) Eligibility

  • You must be at least 18 years old to create an account or purchase tickets without supervision.
  • Participants under 18 require written consent from a parent or legal guardian and may need to attend events with a responsible adult as advised.
  • By using the Services, you confirm you have the legal capacity to enter into these Terms in your jurisdiction.

3) Your account

  • You are responsible for your account credentials and for all activity under your account.
  • Please keep your details accurate and up to date.
  • Notify us promptly of any unauthorised access or suspected breach of security.

4) Memberships, events, and communities

4.1 Events and registrations
  • Event details (date, time, venue, inclusions) are shown on the event page or ticketing platform.
  • We may change a venue, time, or format (including moving online) if needed. If we cancel an event, you’ll receive a full refund or credit.
  • Transfers: If you can’t attend, you may transfer your ticket to another person by notifying us before the event starts.
4.2 Communities of Support and group chats
  • We operate focused communities (e.g., Youth, ICT, Accountability, Creative, AI) and may use third‑party platforms (e.g., WhatsApp, LinkedIn, Facebook) to facilitate discussion.
  • Be mindful that anything you share in groups may be visible to other members. Do not share confidential or proprietary information you are not comfortable disclosing.
  • We may moderate, archive, or remove posts or members to uphold a safe, constructive environment.
4.3 Photos, video, and recordings
  • We may capture photos, audio, or video at events for community documentation and marketing.
  • If you prefer not to be photographed or recorded, please inform a team member on arrival; we’ll provide a no-photo indicator where possible and do our best to accommodate.
  • Do not record or photograph others without their consent.
4.4 Health, safety, and venue rules
  • Follow reasonable directions from staff and comply with venue policies and applicable laws.
  • If you feel unwell or unsafe, please let a team member know immediately.

5) Code of conduct

We keep it simple: respect people and focus on building. We do not tolerate:

  • Harassment, discrimination, or abuse of any kind.
  • Spam, aggressive self‑promotion, or predatory behaviour.
  • Sharing other people’s private information without consent.
  • Illegal activity, plagiarism, or infringement of others’ rights.
  • Disruptive conduct that undermines a safe, inclusive space.

We may remove content or suspend/terminate access for breaches of this Code, at our reasonable discretion. If you experience or witness behaviour that concerns you, please contact us promptly at the event or via our contact details below.

6) Payments, pricing, cancellations, and refunds

  • Prices are shown in Australian dollars (AUD) and may include taxes and fees as stated at checkout. Where applicable, GST will be handled as indicated on the payment page or invoice.
  • Some Services may be offered on a recurring subscription basis; you can cancel at any time, with access continuing until the end of the current billing period.
  • Event refunds:
    • If we cancel an event: full refund or credit, your choice.
    • Change of mind: generally non‑refundable, but you may transfer your ticket to another person before the event.
    • Hardship or special circumstances: contact us before the event; we’ll consider reasonable solutions (credit/transfer).
  • Australian Consumer Law (ACL): Our goods and services come with guarantees that cannot be excluded under the ACL. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.

7) Intellectual property

  • All content we provide (including logos, branding, text, graphics, videos, and materials) is owned by or licensed to StartBNE and protected by law.
  • We grant you a limited, revocable, non‑transferable licence to access and use the Services for personal, non‑commercial purposes in accordance with these Terms.
  • You must not copy, modify, distribute, or create derivative works from our content without prior written permission.
  • STARTBNE and our marks may not be used without our consent.

8) Your content and licence to us

  • You retain ownership of content you post or share. You grant StartBNE a worldwide, non‑exclusive, royalty‑free licence to use, reproduce, adapt, and communicate that content for operating and improving the Services, community engagement, and promoting events. You can revoke future promotional use by emailing us; we’ll action reasonable requests going forward.
  • You confirm you have the necessary rights and permissions for the content you share and that it does not infringe any third‑party rights or laws.
  • We may remove content that breaches these Terms or applicable law.

9) Third‑party platforms and links

Our Services may integrate or link to third‑party platforms (e.g., ticketing, messaging, video, or payment providers). We are not responsible for third‑party services, terms, or privacy practices. Your use of those services is at your own risk and subject to their terms.

10) No professional advice

Information shared through StartBNE (including at events, in groups, or online) is general in nature. Unless we say otherwise in writing, nothing is financial, legal, medical, or other professional advice. Always seek professional advice for your situation.

11) Results not guaranteed

We provide clarity, community, and accountability, but outcomes depend on your actions and circumstances. We do not guarantee results, revenue, or specific opportunities.

12) Beta features, AI tools, and experimental content

From time to time we may offer experimental features (including AI‑assisted tools or prompts). These may change, break, or be withdrawn without notice. Use your own judgment, verify outputs, and do not rely on them for critical decisions.

13) Privacy

14) Security

We use reasonable measures to protect the Services, but no method is 100% secure. You are responsible for safeguarding your devices and accounts.

15) Termination and suspension

  • You may stop using the Services at any time. Cancelling a subscription will take effect at the end of your current billing period.
  • We may suspend or terminate access if you breach these Terms, misuse the Services, or where required by law or to protect users.
  • Upon termination, certain provisions survive (e.g., intellectual property, disclaimers, limitations of liability, indemnities).

16) Warranties and disclaimers

  • The Services are provided “as is” and “as available”. To the maximum extent permitted by law, we disclaim all warranties not expressly set out in these Terms.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you may have under the Australian Consumer Law.

17) Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, loss of profits, or loss of data arising from or in connection with the Services. Where our liability cannot be excluded under the Australian Consumer Law, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.

18) Indemnity

You agree to indemnify and hold StartBNE and our team harmless from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your breach of these Terms, your content, or your unlawful use of the Services.

19) Force majeure

We are not responsible for delays or failures caused by events outside our reasonable control (e.g., extreme weather, outages, strikes, pandemics, government actions).

20) Governing law and disputes

  • These Terms are governed by the laws of Queensland, Australia.
  • If a dispute arises, we both agree to try to resolve it in good faith within 30 days. If unresolved, either party may propose mediation in Brisbane, Queensland. If still unresolved, the courts of Queensland have non‑exclusive jurisdiction.

21) Changes to the Services or Terms

We may update the Services and these Terms from time to time to reflect operational, legal, or regulatory changes. If changes materially affect your rights or obligations, we’ll take reasonable steps to notify you (for example, via email, the website, or group announcements). Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

22) Notices and contact

We may provide notices via email, on‑site announcements, or messages in community channels.

23) Miscellaneous

  • Severability: If any provision is invalid, the remainder remains in effect.
  • No waiver: A delay or failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations in connection with a restructure, merger, or transfer of the Services.
  • Entire agreement: These Terms, together with any event‑specific terms and our Privacy Policy, form the entire agreement between you and StartBNE regarding the Services.

24) Definitions

In these Terms:

  • Services means our website, events, communities, content, communications, and related offerings.
  • Content means text, images, audio, video, and other material shared through the Services.
  • We, us, and our refer to StartBNE. You and your refer to the person or entity using the Services.
